FIRST SECTION
THE HISTORICAL ARCHIVE
Art. 1   Establishment and Competences

The Historical Archive of Assicurazioni Generali is a private archive protected by the Italian law, as it was awarded the status of “historically significant” cultural heritage by the Archival Authority of the Friuli Venezia Giulia region by means of a notifying statement issued on September 23, 1983. The statement was released in accordance with Presidential Decree n. 1409/1963 – subsequently reinforced by Legislative Decree n. 42/2004 – and implies the commitment for the Company to preserving, rearranging and cataloguing the records of the Historical Archive, as well as to granting their full accessibility to users for scientific and historic research activities in accordance with Legislative Decree n. 196/2003.

Art. 2   Composition

The Historical Archive preserves the documents created or acquired by Assicurazioni Generali in the course of its activity. It is made up of the documents pertaining to business of more than forty years of age and which are to be preserved permanently in order to safeguard the Company’s interests, preserve its history and serve the historic-scientific community

Art. 3   Current Legislation

The Historical Archive operates in accordance with current Italian laws on the protection of personal data (Legislative Decree n. 196/2003, Codice in materia di protezione dei dati personali [code on protection of personal data] and Regulation n. 8/P/2001 of March 14, 2001 Codice di deontologia e di buona condotta per i trattamenti dei dati personali per scopi storici [code of conduct for the treatment of personal data for historic research], in compliance with Legislative Decree n. 42/2004 Codice dei beni culturali e del paesaggio [code on the protection of cultural heritage and landscape] and subsequent amendments and updates, as well as in conformity with these Rules and Regulations.

SECOND SECTION
CONSULTATION AND STANDARDS OF CONDUCT FOR RESEARCHERS GENERAL PRINCIPLES
Art. 4   Purposes and Scope

These Rules and Regulations aim at assuring that all data related to Assicurazioni Generali’s activity are used correctly, as well as that they can be properly accessed in accordance with existing Italian regulations on free historic research and the right to education and information and, finally, that access to documents and records is granted without prejudice to the rights of any involved individuals.

Enclosed in these Rules and Regulations are also the guiding behavioral principles applicable to internal and external researchers dealing with records held by the Historical Archive for administrative or scientific purposes. In particular, they identify precautionary criteria for the collection, usage and dissemination of the data contained in the documents.

Art. 5   Applicable Legislation

By accessing information and records of the Historical Archive for administrative or research purposes, any researcher accepts to comply with the applicable Italian legislation on the protection of personal data (Legislative Decree n. 196/2033 and Regulation n. 8/P/2001 of March 14, 2001), with the code on protection of cultural heritage and landscape (Legislative Decree n. 42/2004 and subsequent amendments and updates), with copyright prescriptions (as ruled by Law n. 633/1941 and n.. 248/2000), as well as with these Rules and Regulations.

ACCESS AND USE OF RECORDS
Art. 6   Access

Access is granted free of charge, without restrictions to external or internal researchers, in conformity with current legislation.

Researchers are requested to fill in the registration form, providing their personal data, qualification, ID copy, indication of the subject of their research and, for graduating and doctorate students, a letter of reference by their project supervisor. By filling in the registration form researchers commit to handling and disseminating data in accordance with current legislation, so as to safeguard the interests of Assicurazioni Generali and the Historical Archive.

The registration will be valid for one calendar year and cover any subject of research; the form will have to be updated in case of variations occurring after filling it in.

Researchers are also requested to sign the visitors log any time they enter the Archive venues.

Art. 7   Consultation

The Historical Archive grants free access to consulting documents in conformity with current legislation and according to the degree of safety papers can be handled with in relation to the state of their arrangement.

Requests by Internal researchers shall have a right of priority, so as to facilitate employees in the execution of their working activity.

Researchers are requested to fill in the consultation form, which will be valid for one consultation only, providing their personal information, the indication of the subject of their research and the reference number of the archival items to be pulled (fonds, series, folder, etc.).

Art. 8   Reproduction

Researchers are requested to fill in the reproduction form, providing their personal data, the indication of the subject of their research, the kind of reproduction needed, the reference number of the archival items to be reproduced (fonds, series, folder, etc.), the reproduction purposes and quantity. Reproduction is granted for strictly personal use only, or for research purposes; researchers commit not to disseminating, spreading or selling the copies obtained to the public.

The economic and literary property of any documents created or acquired in the course of the Company’s activity remains with Assicurazioni Generali, so that a copy of any reproduction made autonomously by the researcher will have to be released to the Historical Archive.

Reproduction forms may not be ceded, nor transferred.

Art. 9   Publication

Prior to any publication, researchers are requested to apply for permission to the Historical Archive. Researchers are requested to fill in the publication form, providing their personal data, the indication of the subject of their research, the reference number of the reproduced archival items to be published (fonds, series, folder, etc.), the name of the printed work, journal or periodical magazine where the reproduced items will appear, together with the indication of whether it will be a personal edition or a publication edited by a publishing house.

Summaries, quotations and the reproduction of excerpts of documentation are permitted for the purposes of personal historic-scientific research and teaching projects; the integral publication of any reproduced item for editorial purposes is not permitted, except after permission by the Historical Archive.

The economic and literary property of any documents created or acquired in the course of the Company’s activity remains with Assicurazioni Generali and researchers commit to handing over to the Historical Archive a copy of any publication or graduation/doctoral thesis based on documents held by the Historical Archive.

Legacies, donations or deposit of materials by employees or their heirs containing documentation which can be defined as “intellectual creation” will be regulated by current Italian legislation on the protection of copyright.

The documents to be published will have to be captioned as follows: indication of the preserving institution (Historical Archive Assicurazioni Generali), fonds and partition thereof, reference number, folder, file, title. Moreover, a caption reading “courtesy of the Historical Archive Assicurazioni Generali” will have to be added, together with an explicit note advising of the prohibition of any further reproduction or duplication with any means.

Art. 10   Behavioral standards

Researchers are requested to leave bags, luggage, overcoats, umbrellas, briefcases, pc cases and other personal belongings in the lockers available in the Archive venues. No mobile phones, food, beverages or any other object or substance which might damage the documents are admitted in the reading room, nor are devices for the reproduction of documents or recording appliances, except after permission by the Archive staff.

Moreover, researchers may not: disperse documents or re-arrange their order; lean on them; write on or mark them; alter, fold and damage the materials of which documents are made; damage or remove seals, bands and binding of any kind; view or reproduce documents requested by other researchers; reproduce documents without permission of the Archive staff.

While handling the documents, researchers are requested to wear gloves, as made available by the Archive staff.

Researchers may be issued with only one item at any one time.

Request for documents already being used by a researcher will not be taken into consideration for another, not even in case the documents at issue are held up in the Historical Archive storage rooms.

Art. 11   Sanctions

Any behaviors resulting in actions other than those established in these Rules and Regulations will cause the revocation of the access and consultation permissions, as well as the application of current Italian civil laws on compensation for damage. Should any disputes require an interpretation of these Rules and Regulations, the Italian version will apply.

SERVICES AVAILABLE TO RESEARCHERS
Art. 12   Opening Hours

Access is possible after making an appointment with the Archive staff: Monday to Thursday from 9:30 to 12:30 a.m. and from 2:30 to 4:30 pm; Friday from 9:30 to 12:00 a.m.

Art. 13   Tools provided to researchers

The Historical Archive provides a reading room, a coatroom, a pc work station and archival finding aids.

Art. 14   Use of records

All records can be freely accessed in accordance with current Italian laws, except otherwise provided by the Historical Archive.

All records are available to both internal and external researchers only within the venues of the Historical Archives and subject to the application of these Rules and Regulations.

The records requested will be made available for consultation according to the accessibility of the storage rooms and reading room at the Historical Archive.
